These Terms of Use ("Terms") govern your use of our website located at www.reclaimmw.com (the "Site") operated by Reclaim Mental Wellness, LLC ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Not Medical or Emergency Advice

The content on this Site, including all text, graphics, images, videos, and other materials, is for informational purposes only and does not constitute medical, psychological, or mental health advice, diagnosis, or treatment. Using this Site does not create a therapist-client relationship.

By using this Site, you confirm that you are at least 18 years old or the legal age of majority in your jurisdiction. If you are under 18, do not use this Site without the supervision and consent of a parent or guardian.

Engaging with our educational resources, blog content, or tools does not guarantee any specific results. Mental health is complex and outcomes vary depending on individual circumstances.

7. Messaging Terms & Conditions:

Providing us with your mobile phone number is optional. It will not affect our services to you. By entering your phone number, you agree to receive informational messages (appointment reminders, account notifications, etc.) from Reclaim Mental Wellness, LLC - Julia Loewi Sole MBR. Message frequency varies. Message and data rates may apply. For help, reply HELP or email us at julia@reclaimmw.com. You can opt out at any time by replying STOP.

8. Mobile SMS Messaging Privacy Policy:

    • We may use the information we collect to perform the services requested including billing, customer service, appointment reminders and other administrative requests.

    • Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. This includes text messaging opt-in data and consent.

As a current or prospective customer, you understand that you can text us STOP at any time to opt out of receiving SMS text messages from us. You can text us HELP at any time to receive help.

All policies are followed as per CTIA guidelines 5.2.1. At any time if you want your information to be removed, you can contact us via our email address or regular mail.

9. Appointments and Services

All therapy or coaching services must be scheduled through our secure client portal. Services are governed by separate informed consent and practice policies provided at the time of onboarding. We reserve the right to refuse service for any reason consistent with ethical and legal guidelines.

10. Payment & Cancellation

Payment policies, including fees, insurance reimbursement (if applicable), and cancellation terms, are provided prior to service initiation. Missed appointments or late cancellations may incur a fee.

Website purchases (e.g., digital products) are non-refundable unless explicitly stated otherwise.

11. Limitation of Liability

To the fullest extent permitted by law, Reclaim Mental Wellness and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Site or its content.

12. Indemnification

You agree to defend, indemnify, and hold harmless Reclaim Mental Wellness and its affiliates, employees, and contractors from any claims, liabilities, damages, costs, or expenses arising from your use of the Site or violation of these Terms.

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved in the appropriate state or federal courts located in Sarasota County, Florida.
